For years, social media companies insisted they are neutral platforms, just tools that people use, and nothing else. However, that claim is falling apart. 

In March this year, two U.S. juries (in California and New Mexico), issued landmark decisions against Meta, finding the company liable for harming children through its addictive design, and failing to protect them from sexual exploitation. 

The rulings resulted in hundreds of millions in penalties, marking one of the most significant shifts in how the legal system understands tech companies, not just as passive hosts, but as products whose design can cause real-world harm.

In California, the “Bellwether” addiction trial, found that Meta and YouTube were negligent for designing features like infinite scroll to keep young users online longer, contributing to anxiety, depression, and compulsive use. 

While in New Mexico, the child sexual exploitation case found that Meta misled users about safety and failed to prevent predators from contacting and grooming children on its platforms, ordering them to pay $375 million. 

These verdicts are seen as a turning point. For the first time, courts are acknowledging that online exploitation is not only the result of individual predators, but also the predictable outcome of design choices that prioritize engagement over safety. This opens the door for broader accountability and platforms to rethink the risks built into their products. 

Understanding these outcomes is only part of the story. The bigger question is what must happen next to prevent these harms before they reach victims.

What Needs to Happen: Legal and Systemic Action

If platforms are going to be used like products, then the systems regulating them need to reflect that reality. 

In the U.S., lawmakers should revisit Section 230, which was originally enacted long before algorithms or infinite scroll existed. While doing so, they should clarify that companies can be liable when their design choices amplify harmful content, as well as mandate a “duty of care” standard, requiring platforms to anticipate and mitigate foreseeable harm, and push companies to build safer systems from the start. Some of this thinking is already emerging in proposed legislation such as the Kids Online Safety Act (S.1748), which would require platforms to design with the safety of minors in mind and offer stronger protections by default. 

Moreover, greater openness around algorithmic decision-making and reporting on exploitation risks would help independent experts identify how predators use these tools, and where intervention is most urgently needed.

In Canada, previous efforts to regulate online safety stalled when Bill C-63 (“Online Harms Act”) died after Parliament was suspended in early 2025. But the federal government has since renewed its efforts. In March 2026, it reconvened an expert advisory group on online safety and also introduced Bill C-22, aimed at giving law enforcement and CSIS better tools to investigate online threats, including child exploitation and human trafficking.

By creating independent regulatory oversight, we can ensure that platforms undergo regular safety audits and comply with minimum standards. Additionally, funding must support law enforcement training, survivor-led organizations, and prevention programs that address the roots of exploitation.

The bottom line is that platforms must become active preventers of harm, not passive hosts. The legal frameworks of countries have not kept up to date with the realities of digital design, and until they do, vulnerable users will remain exposed. 

But legislation is only part of the solution. To truly understand exploitation online, we need to examine how platform design itself contributes to trafficking. 

Trafficking Has a UX Problem – A Fresh Perspective

UX as a risk factor

Open any social media app and you’ll see it immediately: the endless scroll, the suggested friends, the flood of messages waiting to be opened. It all feels natural. These platforms are designed with the idea to connect people, and keep them engaged. But those same features could actually be the reason someone's put in harm's way. 

Tools like friend suggestions, direct messages, private groups, and autoplay don’t just increase interaction: they can create easy access points for exploitation. As a result, traffickers don’t need specialized tools or hidden networks. They use the same features everyone else does, and those features create pathways to reach, groom, and control vulnerable users.

Blaming victims vs. blaming systems

In current conversations about online exploitation, too often the victim is blamed: why were they responding, why did they not just block them, why did they trust them. But these questions prevent us from seeing the bigger picture. 

The problem lies not just within how individuals react, but how the platform was built. The question we should ask is: why was the platform designed in a way that made that interaction possible in the first place? In doing so, we shift the focus from victims to the system, allowing us to understand where prevention is needed. 

Platforms as infrastructure

It also helps us think of social media as infrastructure. These platforms are not just tools, but rather work as digital highways or borders, shaping how people interact. And like any infrastructure, design choices influence risk. 

When a system prioritizes growth and engagement over safety, it can create environments where exploitation becomes easy and widespread. In this sense, trafficking is not just opportunistic, but also structurally facilitated. 

Local impact matters

The dangers of these platforms are not only felt in big cities or specific communities. A young person in a small or rural community can just as easily be targeted, because the point of access is digital. 

This means that prevention not only must be global, but also local. Globally, platform design should be addressed, while locally, communities should educate people through awareness campaigns and community support that supports real life contexts. 

Accountability is prevention

This is why accountability matters. When platforms redesign features, prioritize safety, and close the gaps predators rely on, they’re not simply adjusting a user interface. They’re shutting down pathways to harm. 

It’s prevention that happens upstream, long before a child answers a message or accepts a friend request, that helps shift the strategy from reactive victim support to proactive harm reduction.

And by thinking about platform design through a public health lens, (think the food safety, alcohol or tobacco), that's focused on harm reduction, not blame), it gives us a roadmap for prevention that goes far beyond awareness campaigns.

These perspectives illuminate how tech design, policy, and community action intersect. And when combined with legal reform, they represent a real turning point in fighting trafficking.

Call to Action

These aren’t just verdicts. They’re shifts in how courts think about harm and accountability. For the first time, courts are recognizing that the architecture of online spaces shapes vulnerability and enables harm. This shift makes room for opportunities to not only demand accountability, but to redefine what safe digital environments look like.

We can all play a part by learning the signs of online exploitation, speaking up for safer platform design, and supporting community efforts that protect young people where they live and spend their time.

These recent cases remind us that change is possible, and that safer digital spaces are not an impossible dream.

We now have the opportunity to make technology part of the solution, not the problem.
